You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. INTENDED USE FOR REAL ESTATE INVESTMENTS

Seven Flags Investments provides real estate investment services, property management, property sales, and rental services primarily in the Nairobi metropolitan area and other regions in Kenya through our partner network. You may use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services:

In any way that violates applicable laws or regulations

To engage in fraudulent or deceptive practices

To interfere with or disrupt our services

To access or attempt to access confidential information without authorization

5. PRIVACY POLICY

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our services, to understand our practices regarding the collection and use of your personal information. While we strive to provide accurate property information, we cannot guarantee the completeness or accuracy of all property details, including but not limited to square footage, amenities, legal status, or condition. We strongly recommend independent verification and professional inspections before making any purchase or investment decisions.

12. INTELLECTUAL PROPERTY

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEVEN FLAGS INVESTMENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF OUR SERVICES OR ANY INVESTMENT DECISIONS MADE BASED ON OUR RECOMMENDATIONS OR INFORMATION.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS RELATED TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO SEVEN FLAGS INVESTMENTS IN THE 12 MONTHS PRECEDING THE CLAIM.

14. TERMINATION

Either party may terminate this agreement at any time with written notice. Seven Flags Investments reserves the right to suspend or terminate your access to our services immediately if you violate these Terms or engage in prohibited activities. Termination does not affect existing investment obligations or property management agreements, which shall be governed by their separate terms.

15. APPLICABLE LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law principles. For our Kenya operations, local Kenyan real estate laws and regulations shall also apply as required.

Any disputes arising under these Terms shall be resolved through binding arbitration in Newark, New Jersey, or through the courts of New Jersey if arbitration is not available or appropriate.

16. ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy and any specific investment or property management agreements, constitute the entire agreement between you and Seven Flags Investments regarding your use of our services.
